This Privacy Policy describes how Driven MN ("DrivenMN," "we," "us," or "our") collects, uses, stores, discloses, and protects your personal information when you visit, use our services, or make a purchase from DrivenMN.com (the "Site"), communicate with us by phone, text message, email, or in person, or otherwise interact with us (collectively, the "Services"). "You" and "your" refer to you as the user, customer, or visitor.

1. Changes to This Privacy Policy
We may update this Privacy Policy from time to time, including to reflect changes in our practices or for operational, legal, or regulatory reasons. We will post the revised policy on the Site and update the "Last Updated" date. We encourage you to review this page periodically. Your continued use of the Site after any changes constitutes acceptance of the updated policy.
2. Personal Information We Collect
2.1 Information You Provide Directly
When you interact with DrivenMN, you may provide us with the following categories of personal information:
- Contact Information: Name, email address, phone number, mailing address, billing address, shipping address.
- Order & Transaction Information: Products and services ordered, order specifications, payment confirmation, billing details, shipping preferences, order notes.
- Vehicle Information: Vehicle make, model, year, trim level, body style, VIN (if provided), and product specifications selected by the customer (VLT percentages, coverage areas, film types, custom options).
- Account Information: Username, password, and security information used for account access (if you create an account).
- Communications: Content of emails, text messages, phone calls, voicemails, and any other communications you send to us or that we send to you, including customer support inquiries and order-related correspondence.
- Customer Support Information: Information you include in communications with us, such as questions, complaints, feedback, or dispute-related correspondence.
2.2 Information Collected Automatically
When you visit or interact with the Site, we may automatically collect:
- Usage Data: Information about how you access and use the Site, including pages viewed, links clicked, time spent on pages, referring URLs, and navigation paths.
- Device Information: Browser type and version, operating system, device type, screen resolution, and device identifiers.
- Network Information: IP address, internet service provider, and general geographic location (derived from IP address).
- Cookies & Tracking Technologies: We use cookies, pixels, and similar technologies to power and improve the Site. See Section 7 (Cookies) for details.
2.3 Phone Call Recordings
Phone calls to and from DrivenMN are monitored and recorded. An automated notice is played at the beginning of each inbound call informing callers that the call is being recorded. By continuing the call after this notice, you consent to the recording. Call recordings capture the audio content of the conversation, the date and time of the call, the phone numbers involved, and the duration of the call.
Call recordings may be transcribed by third-party transcription services (see Section 5). Recordings and transcripts are stored securely and used for the purposes described in Section 3.
2.4 Text Message / SMS Records
When you communicate with DrivenMN via text message, or when we send you text messages related to your order or service, we collect and retain the content of those text messages, the phone numbers involved, and the date and time of each message. By providing your phone number to DrivenMN, you consent to receiving service-related text messages and to the retention of text message records as described in this policy. See our Terms & Conditions (Section 15) for full SMS consent details.
SMS Program Disclosures (A2P 10DLC Compliance):
- No Sharing of Mobile Numbers or SMS Opt-In Data: DrivenMN does not share, sell, rent, or otherwise disclose mobile phone numbers or SMS opt-in data to third parties or affiliates for marketing or promotional purposes. Mobile phone numbers are used solely to deliver transactional service-related text messages (booking confirmations, appointment reminders, reschedule and cancellation links, post-service follow-ups) and may only be shared with subprocessors that operate the SMS infrastructure on our behalf (e.g., our messaging provider Twilio) under contractual confidentiality obligations.
- Message Frequency: Message frequency varies based on appointment activity and customer interaction. Customers who book a service typically receive 1–4 messages per booking (confirmation, reminders, and follow-up). You will not receive promotional or marketing SMS unless you separately opt in to a future marketing program.
- Message and Data Rates: Message and data rates may apply per your mobile carrier plan. DrivenMN does not charge customers for receiving SMS, but standard carrier rates for incoming text messages and any data usage on your device apply at your carrier's published rates.
- Opt-Out: You may opt out of any non-transactional SMS at any time by replying STOP to any message you receive. Reply HELP for assistance. Opting out of SMS will not affect your existing booking or order obligations, but may prevent us from sending automated reminders.
2.5 Information from Third Parties
We may obtain information about you from third parties, including:
- Shopify, which provides our e-commerce platform and processes transactions on our behalf
- Payment processors (e.g., Shopify Payments) that collect payment information to fulfill orders
- Shipping carriers (FedEx, UPS, USPS) that provide delivery status, tracking information, and delivery confirmation
- Advertising and analytics partners that may collect usage data through cookies and tracking technologies
3. How We Use Your Personal Information
We use your personal information for the following purposes:
- Order Fulfillment: Processing payments, fulfilling orders, producing custom-cut kits to your specifications, arranging shipping, providing tracking information, and communicating order status updates by email, text, or phone.
- Customer Support: Responding to inquiries, resolving issues, providing installation guidance, and managing your account.
- Quality Assurance & Training: Reviewing recorded phone calls and communications to improve our service quality and train team members.
- Order Verification: Confirming order specifications, verifying customer identity, and documenting custom product details communicated by phone, text, or email.
- Dispute Resolution & Legal Use: Using order records, transaction records, shipping documentation, phone call recordings and transcripts, text message records, email correspondence, and screenshots of checkout policies as evidence in chargeback disputes, payment disputes, legal proceedings, fraud investigations, or any other dispute resolution process. This use is necessary to protect our legitimate business interests and legal rights.
- Fraud Prevention & Security: Detecting, investigating, and preventing fraudulent, unauthorized, or illegal activity.
- Marketing & Advertising: Sending promotional emails (with your consent or where permitted by law), displaying relevant advertising, and improving our marketing effectiveness. You may opt out of marketing emails at any time using the unsubscribe link.
- Site Improvement: Analyzing usage data to improve the Site, optimize the shopping experience, and develop new products and services.
- Legal Compliance: Complying with applicable laws, regulations, legal processes, or enforceable governmental requests.
4. Data Retention
We retain your personal information for as long as necessary to fulfill the purposes described in this policy, comply with legal obligations, resolve disputes, and enforce our agreements. Specific retention periods:

After the applicable retention period, personal information is securely deleted or anonymized unless a longer retention period is required by law or an active legal matter.

- Business & Marketing Partners: Partners who help us provide services and advertising, subject to their own privacy policies.
- Dispute Resolution: Credit card companies, issuing banks, payment networks, and dispute resolution services in connection with chargeback disputes, fraud investigations, or payment disputes. Information disclosed may include order records, communications, call recordings and transcripts, text messages, shipping documentation, and checkout policy screenshots.
- Legal Requirements: When required by law, subpoena, court order, or other legal process, or when we believe disclosure is necessary to protect our rights, your safety, or the safety of others.
- Business Transfers: In connection with a merger, acquisition, bankruptcy, or sale of assets.
- With Your Consent: When you direct us to share information or provide consent.
We do not sell your personal information to third parties. We may share information for targeted advertising purposes as described below.

6. Advertising & Information Sharing
We may share certain personal information (such as identifiers, commercial information, and usage data) with business and marketing partners for advertising and promotional purposes. Under certain state privacy laws, this sharing may be considered a "sale" or "sharing" of personal information. You have the right to opt out of this sharing (see Section 10).
We do not use or disclose sensitive personal information without your consent or for the purpose of inferring characteristics about you.
7. Cookies & Tracking Technologies
We use cookies, pixels, and similar technologies to power and improve the Site, remember your preferences, run analytics, and understand how you interact with the Services. We may also permit third parties to use cookies on the Site for advertising and analytics purposes.

Most browsers allow you to remove or reject cookies through browser settings. Removing or blocking cookies may affect Site functionality. Blocking cookies may not completely prevent information sharing with advertising partners.
Our website recognizes the Global Privacy Control (GPC) signal. If you enable GPC, we will treat it as a valid request to opt out of sharing and targeted advertising for the associated browser or device. If we can associate the device with a Shopify account, we will apply the opt-out to the account as well. To learn more, visit https://globalprivacycontrol.org/. Other than GPC, we do not currently recognize other "Do Not Track" signals.
8. Third-Party Websites & Links
The Site may contain links to websites or platforms operated by third parties. We are not responsible for the privacy or security practices of third-party sites. We encourage you to review their privacy policies before providing any personal information. Our inclusion of links does not imply endorsement.
9. Children's Data
The Services are not intended for use by children under the age of 16, and we do not knowingly collect personal information from children. If you are a parent or guardian and believe your child has provided us with personal information, contact us and we will delete it. As of the effective date of this policy, we do not have actual knowledge that we share or sell personal information of individuals under 16.
10. Your Rights
Depending on where you live, you may have some or all of the following rights regarding your personal information:
- Right to Access / Know: Request access to the personal information we hold about you, including details about how we collect, use, and share it.
- Right to Delete: Request deletion of personal information we maintain about you, subject to certain exceptions (such as data retained for legal compliance, dispute resolution, or to complete a transaction).
- Right to Correct: Request correction of inaccurate personal information.
- Right of Portability: Receive a copy of your personal information in a structured, commonly used format.
- Right to Opt Out of Sale/Sharing/Targeted Advertising: Direct us not to "sell" or "share" your personal information or to opt out of targeted advertising. You can exercise this right via the GPC signal or by contacting us.
- Right to Restrict Processing: Request that we stop or restrict certain processing of your information.
- Right to Withdraw Consent: Where we rely on consent, you may withdraw it at any time.
- Right to Appeal: If we decline your request, you may appeal by replying to our response.
- Marketing Opt-Out: Unsubscribe from promotional emails at any time using the unsubscribe link. Opting out of marketing does not affect transactional or service-related communications.
- SMS Opt-Out: Reply STOP to any text message to opt out of non-transactional SMS communications. Opting out of texts does not affect your order obligations.
To exercise any of these rights, contact us using the information in Section 14. We will not discriminate against you for exercising your rights. We may need to verify your identity before processing a request. You may designate an authorized agent to make requests on your behalf with appropriate proof of authorization.
Important Note on Deletion Requests: Certain personal information — including order records, transaction records, phone call recordings, text message records, and communications related to completed orders — may be retained for the periods specified in Section 4 even after a deletion request, where retention is necessary for legal compliance, dispute resolution, tax and accounting requirements, or enforcement of our Terms & Conditions. We will inform you if any of your data falls into a retention exception.
11. Security
We implement commercially reasonable technical and organizational measures to protect your personal information against unauthorized access, loss, misuse, alteration, or destruction. These measures include encryption of data in transit, secure storage of call recordings and transcripts, access controls limiting personnel access to personal information, and regular review of our security practices.
No method of transmission or storage is 100% secure. We cannot guarantee absolute security. We recommend using strong, unique passwords and not sharing your account credentials. If you believe your account has been compromised, contact us immediately.
12. Payment Information
All payment processing is handled by Shopify Payments and/or third-party payment processors. DrivenMN does not directly collect, store, or have access to your full credit card number, debit card number, or bank account information. Payment card information is encrypted during transmission and processed in compliance with PCI-DSS standards by our payment processors. 13. Jurisdiction & International Users
DrivenMN is based in Burnsville, Minnesota, United States. Your personal information may be transferred to, stored, and processed in the United States. If you access the Site from outside the United States, your information may be transferred to the U.S. and processed according to U.S. law, which may differ from the laws of your country.
If you are a resident of the European Economic Area (EEA) or the United Kingdom, we rely on recognized transfer mechanisms such as the European Commission's Standard Contractual Clauses for international transfers, unless the transfer is to a country deemed to provide adequate protection. The legal bases for our processing of your data include: performance of our contract with you (order fulfillment), our legitimate interests (dispute resolution, fraud prevention, business operations), your consent (marketing communications, call recording), and compliance with legal obligations.
These policies are governed by the laws of the State of Minnesota and the United States. Any disputes related to privacy practices shall be subject to the jurisdiction provisions set forth in our Terms & Conditions.
